Binding Agreement: By booking from Nosara.Life, you acknowledge that you are entering into a legally binding agreement according to the terms and conditions (“Terms of Service”, “Terms”) detailed herein, including any additional terms, conditions, and policies referenced directly or linked. This agreement governs your access to and use of the Nosara.Life website and associated services.

Conditional Use: Access to and use of our website and services is expressly conditioned on your acceptance of and compliance with these Terms of Service. If you do not agree to the Terms in their entirety, you are not authorized to use the site or any related services.

Modification of Terms: Nosara.Life reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the site and associated services after any such changes constitutes your acceptance of the new Terms.

Prohibited Conduct: You may not use the site and associated services for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Associations: The agreement and interactions with third-party partners, vendors, or affiliates are subject to separate terms and conditions, which will be disclosed at the time of engagement. Nosara.Life is not liable for the actions or omissions of any third parties.

Jurisdiction and Governing Law: The agreement is governed by and construed in accordance with the laws of the jurisdiction where Nosara.Life is established, without regard to its conflict of law principles.

Limitation of Liability: Nosara.Life shall not be liable for any damages of any kind arising from the use of this site and associated services, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Purchase Commitment: When you make a purchase on the Nosara.Life site, you agree to be bound by the specific payment terms and cancellation policy at the time of booking. These details will be clearly provided during the transaction process.

User Responsibility: You agree to defend, indemnify, and hold harmless Nosara.Life and its officers, directors, employees, and agents from and against any claims, actions, or demands, including, without limitation, legal and accounting fees, alleging or resulting from your use of the site or your breach of these Terms of Service.

Commitment to Third-Party Partners

Irrevocable Payments: All payments for services and accommodations made through Nosara.Life are forwarded to third-party partners 45 days prior to the first check-in date. These payments are irrevocable and non-refundable to Nosara.Life once made.

Contractual Obligations with Suppliers: By entering into this agreement, you acknowledge that Nosara.Life commits to these costs on your behalf in advance to secure the necessary bookings for services and accommodations.

Reservation Fee and Payment Terms

Reservation Fee: A non-refundable reservation fee of $250 USD or the equivalent in your local currency, based on the exchange rate at the time of booking, is required to secure your reservation.

Balance Payment: The full balance of the trip cost must be paid at least 45 days before the first check-in date.

Booking Close to Departure:

  • If booking occurs less than 45 days before departure, 100% of the total cost is required at the time of booking.

Cancellation Policy and Refunds

Amendment of Booking: Changes to bookings can be made without penalty if requested more than 45 days prior to the first check-in date. If changes are requested less than 45 days before the start of the trip, no amendments can be made.

Full Refund Conditions: A full refund will be issued if the cancellation is made 45 days or more before the scheduled departure date, less a $250 administrative fee per person.

Non-Refundable Conditions: No refund will be issued for cancellations made less than 45 days before  the departure date.

Resale of Spot: Nosara.Life will attempt to resell the client’s spot. If the spot is successfully resold, the client will receive a full refund minus a $250 administrative fee per person, or the full amount in travel credits, depending on the client's preference.


Force Majeure

Cancellation Due to Unforeseen Events: If Nosara.Life is forced to cancel a booking due to events beyond its control, such as natural disasters or other force majeure events, it will not be liable for failing to perform its obligations.

Refunds and Credits in Force Majeure: While Nosara.Life will strive to secure some form of compensation for the clients, it cannot guarantee monetary refunds. Nosara.Life may provide vouchers valid for one year, subject to conditions and availability.

Early Departure

No Refunds for Early Departure: If a client chooses to leave the trip early or discontinues the use of Nosara.Life’s services for any reason, Nosara.Life is not obligated to provide a refund or compensation for any unused portion of the trip or services.

Client Acknowledgment: By agreeing to these terms, clients acknowledge that any decision to depart early or stop using services will not result in financial reimbursement, and this condition has been clearly communicated and agreed upon at the time of booking.

Late Arrival or Departure

Client Responsibility for Additional Costs: Clients are responsible for any additional costs incurred due to unforeseen circumstances affecting their departure or departure. This includes, but is not limited to, expenses arising from delayed or lost luggage, the need for additional flights, or any changes to the planned itinerary such as early departure or emergency evacuation. Nosara.Life will not be liable for these additional costs.

Notice Requirement: Clients are advised to notify Nosara.Life as soon as possible in the event of a delay or necessary itinerary change. While Nosara.Life will assist in making alternate arrangements, all resultant costs will be borne by the client.

Price Adjustments and Cancellations

Price Changes: Nosara.Life reserves the right to adjust prices as necessary, which will be communicated at the time of booking or when such changes occur.

Cancellation Rights: Nosara.Life also reserves the right to cancel or change activity dates, with appropriate notification to those booked onto the activity.

Requirement of Waivers for Third-Party Activities

Scope of Nosara.Life's Service: Nosara.Life may facilitate the booking of activities through its concierge services but it does not operate or control the third-party vendors who provide these activities.

Non-Assumption of Liability: Nosara.Life explicitly disclaims any liability related to the safety, quality, or any other aspects of activities conducted by third-party providers. This disclaimer extends to any incidents or dissatisfaction resulting from the services provided by third parties.

Acknowledgment of Separate Entities: Clients acknowledge that third-party providers are independent entities and not agents or employees of Nosara.Life. Consequently, Nosara.Life is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.


Third-Party Legal Compliance and Waivers

Third-Party Requirements: The legal requirements and liability coverage of third-party vendors will vary. Each vendor may have their own set of rules, terms, and liability waivers that clients must agree to prior to engaging in activities.

Third-Party Waivers: By signing the waivers, clients agree to release Nosara.Life and the third-party vendors from any claims of liability for accidents, injuries, or other losses that may occur as a result of their participation in these activities.

Understanding Legal Implications: By signing such waivers, clients acknowledge that they understand and accept the terms set forth, including the relinquishment of certain legal rights that they might otherwise have in the event of injury or loss.


Client Responsibility

Risk Acknowledgment: Clients who choose to participate in activities arranged through Nosara.Life’s concierge service do so at their own risk.

Personal Safety: Clients should take all necessary precautions and make informed decisions about their participation based on their personal judgment, fitness, and medical conditions.


Supervision and Compliance

Adherence to Instructions: Clients agree to follow all decisions and instructions provided by Nosara.Life and its third-party partners, especially concerning safety and operational guidelines.

Right to Remove Participants: Nosara.Life reserves the right to remove any clients from an activity without compensation if their behavior is deemed to endanger themselves or others.


Accommodation and Third-Party Services

Guide Role: The accommodation providers listed on the website serve as guides only. Nosara.Life does not take responsibility for booking or problems arising from accommodation arrangements.

Disclosure of Information: Clients consent to have their contact details shared with third-party partners involved in providing the services. This is strictly for service facilitation purposes and will not extend beyond the necessary scope without explicit consent.


Passports and Visas

Requirement of Valid Passport: Clients must ensure their passport is valid for at least six months beyond the date of their intended return. It is the client’s responsibility to verify their passport’s expiration date and renew it if necessary before travel.

Visa Requirements: Clients are responsible for obtaining all necessary visas for their trip. This includes understanding the visa requirements of the destination country and any transit visa requirements.

Liability for Travel Documentation: Nosara.Life is not responsible if a client is denied entry into a country due to improper or insufficient travel documentation. The responsibility for ensuring all documentation is correct and complete rests solely with the client.

Errors and Omissions

Accuracy of Information: Nosara.Life makes every effort to ensure the accuracy of the information provided in its travel documentation, including brochures and website content. However, occasional errors or omissions may occur.

Limitation of Liability for Errors: Nosara.Life is not liable for any errors, omissions, or unintentional misrepresentations that may appear in its travel materials. Clients are encouraged to verify all details of their travel arrangements at the time of booking.

Reporting Inaccuracies: Clients should report any perceived inaccuracies in Nosara.Life’s provided materials as soon as they are discovered. Nosara.Life will make reasonable efforts to correct any errors brought to its attention.

Additional Provisions

Indemnification: Clients agree to indemnify and hold harmless Nosara.Life from any claims, damages, or expenses arising from the client's failure to obtain or maintain necessary travel documentation or from additional costs incurred due to late departures or departures.

Advice on Travel Restrictions: Nosara.Life recommends that clients consult with relevant embassies or consular services to ensure they have the most current information regarding travel documentation requirements. Clients should also consider consulting travel advisories issued by their government.

Travel Insurance Recommendation: Nosara.Life strongly recommends purchasing comprehensive travel insurance that covers cancellation fees and non-refundable costs. Such insurance can provide a measure of financial protection in the event that you must cancel your trip for covered reasons under the insurance policy.

Non-Compete Clause

Confidential Information and Trade Secrets: The Client acknowledges that during the term of this agreement, they will have access to and may acquire, develop, or contribute to the Company's confidential information and trade secrets. The Client agrees that they will not, without the prior written consent of the Company, disclose or use any such confidential information or trade secrets for their own benefit or for the benefit of any other person or entity, during the non-compete period.

Reasonableness of Restrictions: The Client acknowledges that the restrictions contained in this non-compete clause are reasonable and necessary to protect the legitimate interests of the Company, including its goodwill, confidential information, and trade secrets. The Client agrees that these restrictions will not prevent them from earning a livelihood, as the Client's skills and expertise can be utilized in industries and positions that do not compete with the Company's business.

Severability: If any provision of this non-compete clause is found by a court of competent jurisdiction to be unenforceable, invalid, or void, such provision shall be deemed modified to the extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.

Injunctive Relief: The Client acknowledges that a breach of this non-compete clause will cause irreparable harm to the Company, for which monetary damages would not be an adequate remedy. Accordingly, in the event of a breach or threatened breach, the Company shall be entitled to seek injunctive relief, in addition to any other remedies available at law or in equity, without the requirement of posting a bond or proving actual damages.

Contact and Communication

Feedback and Complaints: Complaints about services or activities must be addressed to Nosara.Life management promptly at the end of the session and followed up in writing within 7 days.
